I recently came across this while looking for something else. This is a motion by Natalie Malonis and will apparently be heard on May 28th.

Apparently, the FLDS attorneys for Annette Jeffs want Natalie to provide her with her files dealing with attorney-client information between her and Teresa. Yeah, that makes a lot of sense – a party-opponent makes a request for your confidential files and you are supposed to just give them up… For the non-lawyer types, a client (and only the client) can waive privilege, and when you are an attorney ad litem and responsible for protecting your clients best interests, that responsibility doesn’t just go away when the case is non-suited. In the instant case, CPS found “Reason to Believe” that Annette had neglected or abused Teresa, which puts Annette’s interests in direct opposition to Teresa’s. Additionally, the location that they want the file sent to is a business address of Merril Jessop, who has been indicted for committing a crime involving Teresa. Ohhhh Kayyyy. That sounds kosher to me – not! Apparently Malonis is willing to provide the files, but only if Teresa will meet with her in private to ensure that this is what Teresa wants, and is not due to pressure from adults in the case. Funny, the FLDS and their attorneys don’t want to do this. Gee, why is that? Could it be that they are, in fact, exerting pressure and they are afraid that Teresa will tell Natalie in a one-on-one meeting not to release the files? It seems to me to be a simple solution if they really want the files and Teresa is doing this of her own free will. Of course, if they are not willing to let Teresa talk to Natalie one-on-one, that also says something. Instead, it will go to Judge Walther…
Perhaps Teresa does not want to speak privately with Malonis; she made the point several times that she did not like or trust Malonis.
An easy way to get over this “problem” (if it is a problem for the judge) is for the judge to interview Teresa.
Why would Teresa need her own lawyer, and if she can afford one, why shouldn’t she have to pay her original attorney bills instead of the state of texas paying them?

I thought Teresa a child – unable to make her own choices – she needs an adult to decide legal issues.
Wasn’t THAT what Malonis was saying a few months ago?
So according to Malonis, when Malonis has power over Teresa, Teresa is a child unable to make her own decisions but….when her parents have the power (which the court returned to them), Teresa now can exercise her own free will and consent.
When Teresa wrote a letter to Judge Walther explaining her opinion on Ms. Malonis and her relationship, she was very articulate to give her opinion right about how grown up she was? Now she can’t face this attorney? Who really wrote that letter?
So why are her parents so scared to let grown up Teresa speak up for the files?
Because Malonis is right! Teresa is still a child and cannot make her own decisions, and the FLDS know this. They groom their children to obey and not think for themselve, something CPS seem to over look.
Teresa has been coached by her parents and “Willie” thoughout the whole ordeal and continues to be controlled by these people because they need those files to save Merril and Raymond’s butt.
If they get the information to protect Merril’s butt, Teresa will be back cleaning toilets at the ranch.
The only problem arised because Teresa became of age in physcial form, but not in emotional, and stupid CPS was duped again.

My point exactly. Judge Walther would be able to talk to Teresa one-on-one and make a determination, although if she is really mature enough, why would she not be able to tell Malonis the same thing face to face?

Wow, there’s a shock. And that means Annette’s interest’s are in opposition to Teresa’s.

I don’t think this is correct procedure. Ms Malonis didn’t represent Annette Jessop, and therefore she has NO rights to Teresa’s file.
How many times has Bruce Wisan filed for all legal paperwork from Rod Parker’s firm on Flds? A judge even ordered Parker’s firm to turn over all legal papers to Wisan.
And to this day, NOTHING has been turned over.
If I was Ms Malonis, Id tell Annette Jessop just how far to stick her motion, where the sun don’t shine.

It actually is the correct procedure.
Annette, by herself, has no right to the files.
Teresa does have a right to the files, and can request that they be turned over to another attorney, or can release Natalie from attorney-client privilege. The problem in this case is that Teresa was subjected to improper adult influence during the case, to the point that Judge Walther had to issue orders to Annette, et al, limiting the improper influence.
Natalie has to make sure that this is really Teresa’s desire, and the only way to do that since the adult FLDS members apparently won’t let Teresa talk to Natalie one-on-one is to have the Judge decide.
This seems very strange to me. Teresa Jeffs is supposedly a “big girl” now. She turned 17 and was non-suited.
So, Teresa the “Big Girl” should if she wants her file, speak to Ms Malonis or Judge Walther alone without coercision from other Adults, especially Annette Jeffs! or Willie Jessop!
Im sorry, but Teresa Jeffs isn’t charged with a crime, why would she need an attorney?
She’s free as a bird to come and go as she pleases.

Either (a) “they” are pressuring her, or (b), they are not. If a, then they can easily tell her what to say in advance of any meeting with Malonis, hence having her say what they want to Malonis. If (b), then the whole question is moot.

The FLDS has a long history of not trusting their women (probably because of the abusive way they treat them), so they may be worried that Teresa won’t follow their instructions unless they are there to supervise her.
